The Kaduna governorship election petition tribunal has struck out a preliminary objection filed by Uba Sani, the state governor, against the Peoples Democratic Party (PDP) and its candidate, Isah Ashiru.
Sani had prayed the tribunal to dismiss Ashiru and PDP’s petition because it was filed outside the 21 days permitted by law.
While ruling on the matter via Zoom, the three-member panel led by Justice Victor Oviawe, dismissed Sani’s prayer.
The tribunal affirmed that the petition was filed on April 10, 2023.
It also dismissed another preliminary objection filed by Sani and APC asking the court to dismiss the PDP and Ashiru’s suit for abandoning their petition.
The tribunal is now determining the main petition.
The PDP and its candidate are challenging the declaration of Sani, candidate of the All Progressives Congress (APC), as winner of the March 18, 2023 governorship poll.
